Profile

Robert McEwan has over thirty years experience as an attorney and concentrates his practice in land use law, particularly in the area of project development and zoning matters. Mr. McEwan has represented developers and municipalities providing advice as to zoning issues and state environmental quality review act requirements. He has successfully litigated a number of zoning and SEQR-related matters both on behalf of municipalities and developers.

Mr. McEwan's practice also includes the representation of litigants in commercially-related civil actions. In addition to his land use litigation experience, Mr. McEwan has litigated contract disputes, general civil litigation, article 78 proceedings, tort claims, and citizen suit and other environmental litigation, including multi-party litigation under state and federal Superfund laws and the NY Navigation Law. Mr. McEwan's experience includes the litigation of cases before state and federal courts, administrative litigation experience before the New York State Board on Electric Generation Siting and the Environment pursuant to Article X of the Public Service Law and before the New York Department of Environmental Conservation, and matters before arbitrators and mediators. Mr. McEwan has also served as an arbitrator.

Mr. McEwan also concentrates his practice in environmental law, particularly the defense of environmental enforcement matters, the regulation of solid and hazardous waste, and water and land use matters. Mr. McEwan has represented the owners and operators of solid waste facilities in compliance, permitting and enforcement matters, including enforcement matters with respect to inactive hazardous waste disposal sites. Mr. McEwan has negotiated consent orders with state and federal regulatory agencies for solid waste, water, and wetlands enforcement matters. Mr. McEwan has been involved in negotiating permit terms for various types of facilities. His experience includes the preparation and review of documents for recycling and waste disposal procurements and he has represented municipalities in the procurement of solid waste facilities and services pursuant to GML §120 w.

Mr. McEwan has lectured on environmental topics for the New York State Bar Association and the Albany County Bar Association and has lectured on the public procurement of agreements under NY General Municipal Law §§ 103 and 120-w.

Admissions

Mr. McEwan is admitted to practice in the states of New Jersey and New York, and before the United States District Courts for the District of New Jersey and the Northern, Southern, Eastern and Western Districts of New York. He is also admitted to practice before the United States Second Circuit Court of Appeals and the United States Supreme Court.
